# Loi fédérale sur le partenariat enregistré entre personnes du même sexe (2005)

## Description

Aujourd’hui, en Suisse, les couples homosexuels sont désavantagés dans divers domaines de la vie quotidienne. La nouvelle loi fédérale «sur le partenariat enregistré entre personnes du même sexe» améliore leur statut juridique sans pour autant assimiler le partenariat enregistré au mariage.

La nouvelle loi permet à deux personnes du même sexe de faire enregistrer leur partenariat à l’office de l’état civil et de lui donner ainsi une assise légale. Le partenariat enregistré crée une communauté de vie impliquant des droits et des devoirs. En matière d’impôts, de successions, d’assurances sociales et de prévoyance professionnelle, par exemple, les partenaires enregistrés ont le même statut que les couples mariés.

La nouvelle loi ne permet par contre pas à deux femmes ou à deux hommes d’adopter un enfant ensemble, ni de recourir à la procréation médicalement assistée. Ces couples ne peuvent donc pas fonder une famille au sens strict du terme.

La loi sur le partenariat a fait l’objet d’un référendum. Le comité référendaire estime qu’elle met en péril le mariage et la famille et qu’elle est inutile parce que le droit en vigueur permet déjà suffisamment aux couples homosexuels de réglementer leur relation.

Le projet a été accepté.

In the embed URL, `dm` sets what is shown: `e` the map with its title bar (default), `p` also the values of an object clicked on the map, `m` only the map with a button that opens it in the atlas. `ig=1` (default) lets the map react to scrolling and dragging only after a click into it, `ig=0` right away. The size can be changed in `style`.
